The development of family legislation does not stand still. The introduction of new requirements is due to external factors: crisis, unemployment, impunity for non-payment of alimony, etc. The state is obliged to provide the rights of unprotected social categories of persons: children, old people, disabled people, etc. Therefore, it is important that the legislation is made by the relevant amendments when changes in society.

This article outlines information about the child's alimony under the new law of 2017.

New in Aliments 2017

Innovations in alimony legal relations are aimed at tightening the punishment of aliments:

  • temporary restriction of the rights to managing vehicles;
  • the creation of additional subdivisions of the baits involved in directly recovery of alimony and debt on payments;
  • establishing minimum payments for alimony;
  • extension of payments until the end of the end of the educational institution for full-time.

Temporary deprivation of driver's license is one of the measures aimed at the rapid repayment of the formed alimony debt.

It is forbidden to seize the driver's licenses if:

  • amount of debt less than 10 000 r.;

This is due to the fact that the staff were exempted from the rest of the work, and all the forces were aimed at searching for debtors and receiving payments on executive documents.

For 2016, the minimum payouts in the solid amount were not established, but the draft law on the establishment of a lower limit in 15,000 p was repeatedly applied to the Duma. Currently, the minimum amount of alimony can only be calculated in percent. The amount of payments is determined based on the minimum wage set in a certain region or, in the absence of an indicator, in the country as a whole.

Special excitement received a bill on the extension of payments to 23-24 years. It is assumed that in 2017 it will be taken. Thus, children who entered the full-time education in a higher or secondary educational institution will be able to count on financial assistance from their parents until graduation.

The legislators also propose to make a new on the payment of alimony into legislation:

  • payment of removable housing of the child in case there is no home / apartment itself;
  • changing the procedure for proving in the event of a recovery of further alimony by a child with a child.

The size of alimony to the child under the new law 2017

As before, alimony is accrued:

  • in shares;
  • mixed form.

The percentage of payments is determined by the number of children, so:

  • on the only dependent accounts for one fourth part of the income;
  • on two - one third;
  • on three or more children - half of earnings.

Before the introduction of amendments to establish a solid amount of alimony (minimum), payments are determined:

  • the health of the alimony-payer;
  • the number of persons on the content of the alimenter;
  • other factors affecting a court decision (the presence of profit real estate).
  • the needs of the child (payments are given to the rationale).

The mixed form combines two of the above described. It is applied if the payments in percentages are not enough, and the debtor has additional sources of income. As before, the alimony for a disabled child under the new law 2017 is often charged in mixed form. This is due to the fact that in addition to the main costs, additional costs of rehabilitation, treatment, medicines, etc. are required.

Calculation of alimony to a child under the new law 2017

Carried out according to the following formulas:

payment of labor × 25% \u003d payments per minor;

salary × 50% \u003d payments on three or more children.

As can be seen from the example, the size of the alimony increased. If in 2017 will grow at least, then payments will increase accordingly. In the case of a decrease in this value, the amount of payments remains at the same level.

  1. Deprivation of driver's license.

Thus, the state stimulates debtors to pay money on debts and prevent such a situation in the future.
